Terms of Service

You are agreeing on behalf of the organization you name when you sign up, and you confirm that you are authorized to do so. Each person you invite to your organization becomes a user under these terms, and you are responsible for their use of the service.

• A trial lasts 30 days from signup, needs no payment details, and carries no obligation to subscribe.
• A trial is sized for evaluation: one user and up to 1,000 assets. Subscribing lifts those limits; a paid plan includes up to 50 users.
• When the trial ends, the service becomes read-only for 30 days. You can still sign in, export your data, or subscribe, and everything you added stays where it is. After that period the trial data is deleted as described in the privacy policy.
• The trial is provided as is, for evaluation, and we may end a trial early if it is used in breach of these terms.

Keep the information on your account accurate and your credentials private. You are responsible for activity under your account and your organization's users. Tell us promptly if you believe an account has been compromised.

• Everything you and your users put into the service belongs to your organization. We claim no ownership of it.
• You grant us the limited license we need to store, process, back up, display, and transmit that data in order to run the service for you and to provide support you ask for. That license ends when the data is deleted.
• You are responsible for having the right to put the data into the service and for its accuracy. Do not enter data you are not permitted to share with a hosted service.
• We protect your data as described on our security page and handle it as described in our privacy policy.

Use the service only for its purpose: tracking your organization's assets and operations. You may not:

• attempt to access another organization's data or any part of the service you are not authorized to use;
• probe, scan, or test the service for vulnerabilities without our written permission, or interfere with its operation;
• upload content that is unlawful, infringing, or malicious;
• resell the service or offer it to third parties as your own;
• use automated means to create accounts or trials.

Prices and what each plan includes are on our pricing page. Paid subscriptions are invoiced as agreed in your order and are due on the terms stated there. We may change prices for future terms with notice before your renewal. Public entities that require their own contract form should contact us; a signed agreement replaces this section.

We work to keep HP Solve available and improve it continuously, which means features change over time. We do not offer a service-level commitment on the free trial. Service-level terms for paid subscriptions, where offered, are in your order or agreement.

HP Solve, including its software, design, and documentation, is owned by HydroPro and its licensors. These terms give you the right to use it, not ownership of it. Feedback you choose to give us may be used to improve the product without obligation to you.

The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that the records you keep in it satisfy any regulatory requirement that applies to you.

To the fullest extent permitted by law, neither party is liable to the other for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, however caused. Our total liability arising out of these terms or the service is limited to the amount you paid us for the service in the twelve months before the claim, and for a free trial, to one hundred US dollars. These limits do not apply to a party's breach of its confidentiality obligations, infringement of the other party's intellectual property, or liability that cannot be limited by law.

You may stop using the service at any time; to end a trial early or cancel a subscription, email support@hp-solve.com. We may suspend or end your access if you materially breach these terms and do not cure the breach within a reasonable time after notice, or immediately where the breach threatens the service or other customers. On termination, your data is retained and then deleted on the schedule in the privacy policy.

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, and any dispute will be brought in the state or federal courts located in Texas. Nothing in this section limits a public entity's rights under the laws that govern it.

We may update these terms. The date at the top of this page shows the current version. For material changes we notify account owners by email at least 30 days before they take effect; continuing to use the service after that date accepts the new terms.
